Can you sell cheesecake from home?

11 of 51 jurisdictions (50 states plus DC) allow cheesecake to be made in a home kitchen under cottage food rules, often with conditions, and 3 more allow it with a special home license or program. 35 require a commercial kitchen. Here's why, and where each state lands.

The food science

Cheesecake combines cream cheese and eggs in a high-moisture, low-acid filling. That makes it a TCS food, one that needs refrigeration to stay safe. A few states now allow refrigerated foods from home kitchens under extra rules, but in most states cheesecake requires a commercial kitchen.
